FACTS: On September 28, 1993, at approximately 6:00 A.M., suffering from breathing difficulties and a cough, Tyler Garrison was taken to the emergency department of Seminole Memorial Hospital in Seminole, Texas. Tyler was treated and released with prescriptions. That evening, Tyler's condition worsened, and he was returned to the hospital where subsequently, three attempts were made before endotracheal intubation was achieved. On September 29, Tyler was transferred to University Medical Center in Lubbock, Texas. On September 30, the decision was made to extubate Tyler, after which he suffered significant respiratory distress and an attempt was made to manage the airway by bag-valve-mask. The procedure was unsuccessful and reintubation was attempted, during which Tyler suffered asystolic arrest.
Plaintiffs brought action alleging negligence as to inappropriate treatment and improper procedures, among other things.
