Traumatic Brain Injury Verdicts: Bo Wei, Et Al. v. Mack-Cali Corp., Et Al.

Bo Wei, et al. v. Mack-Cali Corp., et al.

Result: $1.8 million settlement

State: New Jersey

Injury: Shoulder and collarbone fractures and closed head injury, including a Traumatic Brain Injury, with hematoma in the brain and severe scalp and facial lacerations

Defense: Allegations denied; claimed that falling wood did not come from Plaza 5 construction site, but a nearby site.

Background: Sources told Mealey Publications that on Sept. 11, 2002, Bo Wei was walking from his job to a waiting shuttle bus parked next to the Plaza 5 building, at the Harborside Financial Center in Jersey City, N.J., on an extremely windy day when he was struck in the head by a 4-foot by 8-foot piece of plywood that flew off the building. Wei, sources said, was knocked unconscious and suffered shoulder and collarbone fractures and a closed head injury, including a Traumatic Brain Injury, with hematoma in the brain and severe scalp and facial lacerations.

Sources said Plaza 5 was a 34-story office building that was still under construction. Mack-Cali Corp. owned the building being constructed, while Guardsmark LLC was the security firm hired to patrol the property, sources said. Cal-Harbor V. Leasing Associates and Cali Harborside Associates LP were the land owners, sources said, and Jeffrey M. Brown Inc. and Jeffrey M. Brown and Associates were the general contractors of the construction site. Wei and his wife, Kang Chen, sued Mack-Cali, Guardsmark, Cal-Harbor, Cali Harborside, Jeffrey M. Brown Inc. and Jeffrey M. Brown and Associates on July 6, 2004, in the Middlesex County Superior Court.

Wei has been unable to work since being injured, sources said, and he spends most of his days secluded in his bedroom alone, away from his wife and two daughters. Sources said a negligence case against Guardsmark, a security company, for its negligence in failing to properly inspect the property for construction material hazards is still pending.
