FACTS: At approximately 8:00 a.m., on November 26, 1997, Plaintiffs were in a vehicle traveling in a southerly direction on Blue Mound Road located in Fort Worth, Texas. While making a left turn onto Northwest Highway 287, both suffered injuries in a collision with a 1968 Chevrolet 6-wheel grain hauler truck, operated by Defendant. Plaintiffs claimed the collision was due to Defendant Gabel's failure to turn his vehicle lights on while traveling in heavy fog. Although Defendant Gabel did not make an appearance at trial, he denied negligence, contending his vehicle lights were operating at the time but Plaintiffs' vehicle cut across his path of travel.
