SUMMARY: Plaintiff presented to labor and delivery with spontaneous rupture of membranes and irregular contractions. The records indicted celphalopelvic disproportion and shoulder dystocia. Although the plaintiff was prepped for a c-section, the baby was delivered vaginally. The baby was stuck in the birth canal for 10 minutes and was diagnosed with severe depression and birth asphyxia, multi-organ failure, hypocalcemia, hypoglycemia, thrombocytopenia, liver dysfunction, right Erbs palsy, seizures, and pulmonary hypetension. The primary damage was cognitive with mild hemiparesis and more evidence of Erbs Palsy. Apgars were 0 at one minute and 0 at five minutes; and 4 at six minutes. The child will never live independently and will require supervised care throughout her life.
