FACTS: On January 19, 2000, at approximately 10:55 p.m., Scott Bush, a practicing optometrist, walked into Defendant Columbia's emergency room complaining of rapid heart beat and headaches. Dr. Bush gave a history of ventricular tachycardia or rapid heart rate and indicated he was taking a medication, Tambocor, for the condition. Defendant Crain took a medical history but failed to determine dosage and medication time of the Tambocor. An EKG was performed and the emergency room physician diagnosed Dr. Bush as having ventricular tachycardia. At 11:35 p.m. Dr. Bush was administered Verapamil. Within 2 minutes, Dr. Bush experienced decreased heart rate and respiration, reduced blood pressure, became unresponsive and began convulsions. Dr. Bush was resuscitated and transferred to ICU at 12:28 a.m. Suit was brought for negligence claiming failure to take appropriate medical history and inappropriate administration of a contraindicated drug. Defendants denied negligence and argued that their actions had been appropriate due to the unique nature of the case and in face of a life threatening situation.
