CPR wins $933,000 verdict against Neurosurgeon

In what is believed to be one of the largest York County Pennsylvania jury verdicts ever in a medical malpractice suit, Cohen Placitella & Roth's trial lawyers Harry M. Roth and William D. Marvin obtained a $933,000 compensation award against a York County neurosurgeon. The firm established at trial that the defendant doctor seriously injured and disabled the late husband of the firm's client by misplacing a shunt in his brain during an implant procedure. The shunt was intended to drain cerebrospinal fluid and relieve the client's husband's normal pressure hydrocephalus condition. After the surgery the client's 74 year old husband required extensive nursing home, rehabilitation and medical care, but ultimately died 10 months after the surgery. The verdict followed a four day trial in the York County Court of Common Pleas. Plaintiff's counsel expects to petition the court for an award of more than $400,000 in delay damages under Pennsylvania civil procedure, which if granted would bring the total verdict in the range of $1.34 Million.
